01Acceptance of these terms

These Terms of Service (the “Terms”) govern your access to and use of Second Ear (the “Service”). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

02The service

Souncery provides AI-assisted mixing and mastering analysis for audio you upload, including comparisons against reference tracks. Analysis output is provided for informational purposes only and represents an automated estimate. You are responsible for your own creative and technical decisions; we do not guarantee any particular result or outcome.

03Accounts and eligibility

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account. You must be old enough to form a binding contract in your jurisdiction to use the Service.

04Subscriptions and billing

Paid plans are billed in advance on a recurring basis (monthly or annually, as selected at checkout) through our payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method for the then-current price plus applicable taxes. Subscriptions renew automatically at the end of each billing period until cancelled. We do not store your full card details; payment information is handled by Stripe.

We may change plan pricing or features. Price changes apply to billing periods that begin after we provide notice, and your continued use after a change takes effect constitutes acceptance of the new price.

05Refunds and withdrawal rights

If you are a consumer located in the European Union, you may have a legal right to withdraw from an online purchase within 14 days without giving a reason. For digital services and digital content made available immediately after purchase, you agree that we may begin providing the Service right away and acknowledge that, where permitted by law, you may lose your right of withdrawal once access or performance begins.

Cancelling stops future renewals; it does not automatically refund amounts already paid. Nothing in these Terms limits any mandatory rights you may have if the Service is defective, unavailable, or not as described.

06Cancellation

You may cancel your subscription at any time from the billing area in your account settings. Cancellation takes effect at the end of the current billing period, and you retain access to paid features until then.

07Acceptable use

You agree not to misuse the Service, including by:

• uploading content you do not have the rights to use;
• attempting to disrupt, reverse engineer, or gain unauthorized access to the Service;
• using the Service to violate any law;
• abusing usage limits or automation in a way that degrades the Service for others.

08Your content

You retain ownership of the audio and other content you upload. You grant us a limited license to process, store, and analyze your content solely to provide the Service. You are responsible for ensuring you have the necessary rights to the content you upload.

09Intellectual property

The Service, including its software, models, and design, is owned by Souncery and its licensors and is protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding.

10Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that analysis results will be accurate or complete.

11Limitation of liability

To the maximum extent permitted by law, Souncery will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

12Termination

We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that may cause harm to us or others. You may stop using the Service at any time.

13Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
